These Terms and Conditions govern the rental of storage units and open-terrain park-ing spaces at Easy St. Storage, located at 18803 FM 1431, Jonestown, TX 78645. By renting a unit or parking space at this facility, you agree to be bound by the terms set forth below. Please read this document carefully before completing your rental.

1. Rental Agreement

The rental of a storage unit or parking space at Easy St. Storage constitutes a binding month-to-month rental agreement between the renter (referred to as “Renter”) and Easy St. Storage (referred to as “Facility”). This agreement begins on the date the rental is confirmed and continues on a month-to-month basis until terminated by either party in accordance with Section 10 of these Terms.

The Renter must be at least 18 years of age to enter into a rental agreement. By completing a rental, the Renter represents that all information provided is accurate and complete.

2. Rental Rates and Payment

2.1 Monthly Rates

Storage unit rental rates are as follows:

  • Medium unit (9 ft × 25 ft × 6’8″ clearance): $125 per month
  • Large unit (14 ft × 20 ft × 8’6″ clearance): $150 per month
  • Extra-Large unit (14 ft × 28 ft × 8’6″ clearance): $175 per month

Open-terrain parking rates are determined individually and confirmed in writing prior to the start of the rental period.

The Renter must be at least 18 years of age to enter into a rental agreement. By completing a rental, the Renter represents that all information provided is accurate and complete.

2.2 Payment Due Date

Rent is due on the same calendar day each month as the start date of the rental. Payment must be received by the due date to avoid late fees.

2.3 Accepted Payment Methods

The Facility accepts payment online through its tenant management portal. Details are provided upon confirmation of the rental agreement.

2.4 Late Fees

If payment is not received within five (5) days of the due date, a late fee of $25 will be assessed. If payment is not received within fifteen (15) days of the due date, access to the storage unit or parking space may be suspended until the outstanding balance is paid in full.

2.5 Returned Payments

A fee of $35 will be assessed for any returned or declined payment.

3. Access

3.1 Access Hours

The Facility is accessible to authorized Renters every day from 6:00 AM to 10:00 PM. Access outside of these hours is not permitted.

3.2 PIN Code

Upon confirmation of the rental agreement, the Renter will receive a personal PIN code for the facility’s automatic entry gates. This PIN code is for the Renter’s personal use only and must not be shared with unauthorized individuals. The Facility reserves the right to deactivate a PIN code at any time in the event of non-payment, breach of these Terms, or for security reasons.

3.3 Authorized Access

Only the Renter and individuals expressly authorized by the Renter in writing may access the rented unit or parking space. The Renter is responsible for the conduct and actions of all individuals who access the Facility using the Renter’s PIN code.

3.4 No On-Site Staff

The Facility does not have on-site staff available during access hours. Entry and exit are managed exclusively through the PIN-coded gate system. For assistance, contact the virtual office at (713) 320-5251 during business hours, Monday through Friday, 8:00 AM to 5:00 PM.

4. Permitted and Prohibited Uses

4.1 Permitted Use

Rented units and parking spaces may be used solely for the storage of personal or business property as agreed upon at the time of rental. Units are designed for the storage of boats, watercraft, trailers, and recreational vehicles. Open-terrain spaces are for the parking of vehicles and equipment as specified in the individual parking agreement.

4.2 Prohibited Items

The following items are strictly prohibited from the Facility at all times:

  • Flammable, explosive, or hazardous materials, including but not limited to gasoline, propane, chemicals, and ammunition
  • Perishable goods or food items
  • Living animals or plants
  • Illegal substances or stolen property
  • Items that emit odors that may affect neighboring units
  • Any item prohibited under federal, state, or local law

Fuel tanks on stored vehicles must be emptied or sealed to minimum safe levels prior to storage. The Facility reserves the right to inspect units where prohibited items are reasonably suspected.

4.3 Prohibited Activities

The following activities are prohibited on Facility grounds at all times:

  • Conducting business operations of any kind from a unit or parking space
  • Residing or sleeping on the Facility premises
  • Disposing of trash, waste, or any material on the Facility grounds
  • Damaging or tampering with Facility infrastructure, gates, cameras, or lighting
  • Blocking access lanes or other renters’ units
  • Bringing unauthorized individuals onto the property

5. Insurance

The Facility does not provide insurance coverage for stored property. The Renter is solely responsible for obtaining adequate insurance coverage for all items stored at the Facility. The Facility strongly recommends that all Renters maintain an active insurance policy covering stored property against theft, fire, weather damage, and other risks.

The absence of insurance coverage does not limit the Facility’s right to enforce these Terms or collect outstanding balances.

6. Liability

6.1 Limitation of Liability

Easy St. Storage shall not be liable for any loss, damage, or injury to the Renter’s property or person arising from theft, fire, flood, natural disaster, vandalism, or any other cause beyond the Facility’s reasonable control. The Facility’s liability for any claim arising from this agreement shall not exceed the total monthly rent paid by the Renter in the three (3) months preceding the claim.

6.2 Security Measures

The Facility maintains security cameras, perimeter fencing, LED lighting, and PIN-coded gate access as security measures. The presence of these measures does not constitute a guarantee of security or create additional liability for the Facility. Security footage is retained for a limited period and may be reviewed in the event of a reported incident.

6.3 Indemnification

The Renter agrees to indemnify, defend, and hold harmless Easy St. Storage, its owners, employees, and agents from any claims, damages, losses, or expenses — including reasonable attorney’s fees — arising from the Renter’s use of the Facility or any breach of these Terms.

7. Condition of the Unit

The Renter agrees to maintain the rented unit or parking space in good condition throughout the rental period. Any damage caused by the Renter or by individuals authorized by the Renter — beyond normal wear and tear — will be repaired at the Renter’s expense.

The Renter must not make any modifications, alterations, or additions to the unit or parking space without prior written consent from the Facility.

8. Locks

Storage units are secured by the Renter’s own lock. The Facility does not provide locks and is not responsible for the security of any unit that is unlocked or improperly secured. The Renter is responsible for ensuring that their unit is properly locked after each visit.

In the event of non-payment or default, the Facility reserves the right to place an additional lock on the unit in accordance with Texas law until the outstanding balance is resolved.

9. Lien Rights

In accordance with Chapter 59 of the Texas Property Code (the Texas Self-Storage Facility Act), the Facility has a lien on all property stored in a rented unit for unpaid rent, fees, and other charges. If rent or other charges remain unpaid for a period of thirty (30) days or more, the Facility may:

  • Deny the Renter access to the unit
  • Send written notice to the Renter’s last known address and, where available, by electronic communication
  • Advertise and sell the stored property at public sale after the required notice period has elapsed

The Renter will be responsible for all costs associated with the enforcement of this lien, including advertising costs and reasonable attorney’s fees.

10. Termination

10.1 Termination by Renter

The Renter may terminate the rental agreement at any time by providing written notice to the Facility at least ten (10) days prior to the next billing date. Rent is not prorated for partial months unless otherwise agreed in writing. The Renter must remove all property from the unit or parking space and return it in the condition described in Section 7 prior to the termination date.

10.2 Termination by Facility

The Facility may terminate this agreement with ten (10) days written notice for any reason, or immediately in the event of a material breach of these Terms, including but not limited to non-payment, storing prohibited items, or unauthorized use of the premises.

10.3 Holdover

If the Renter continues to occupy the unit or parking space after the termination date without written agreement from the Facility, the Renter will be charged the standard monthly rate on a day-to-day basis until the space is vacated.

11. Abandonment

Property remaining in a unit or parking space after the termination of the rental agreement, and after the Renter has ceased to make payments or respond to Facility communications for a period of thirty (30) days, may be considered abandoned. Abandoned property will be handled in accordance with Chapter 59 of the Texas Property Code.

12. Amendments

The Facility reserves the right to amend these Terms and Conditions at any time. Renters will be notified of material changes at least fifteen (15) days in advance by email or written notice. Continued use of the Facility after the effective date of the amended Terms constitutes acceptance of the changes.

13. Governing Law

These Terms and Conditions are governed by the laws of the State of Texas. Any disputes arising from this agreement shall be resolved in the courts of Travis County, Texas. The Renter waives any objection to venue in Travis County.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with the individual rental confirmation provided to the Renter at the time of sign-up, constitute the entire agreement between the Renter and the Facility. They supersede all prior communications, representations, or agreements, whether written or oral.
